The short answer

The SAFE MLO license covers residential mortgage origination for consumers. Commercial lending is largely outside the consumer protection framework and generally does not require this license.

A question that comes up because the two jobs sound similar and are regulated completely differently.

What this license covers

Residential mortgage loans to consumers, secured by a dwelling. That is the scope of the SAFE Act and of everything in the exam.

Regulation Z, RESPA and ECOA are consumer protection statutes. They exist because a consumer buying a home is in an asymmetric transaction.

The regulatory difference follows from the borrower. A commercial borrower is assumed to be sophisticated and represented, so the protective apparatus is largely absent.

The exam tests the boundary

A loan to an entity for a genuinely commercial purpose falls outside the consumer rules. A loan to an individual secured by their home falls inside them regardless of what they say the money is for. Purpose and borrower both matter.

Investment property

The awkward middle. A loan on a residential rental property may or may not be a consumer credit transaction depending on the purpose and the structure.

This is where occupancy misrepresentation becomes fraud - the borrower is claiming a status that changes which rules apply and what the loan costs.

Moving between them

The underwriting logic differs fundamentally. Residential underwrites the borrower; commercial underwrites the asset and its income. The transferable skill is relationship building rather than technical knowledge.
