When you need a variance, and what one actually is

The short answer

A variance is written approval from the regulatory authority to deviate from a Food Code requirement. Six special processes generally need one plus a HACCP plan, including curing for preservation, reduced-oxygen packaging and sprouting seeds.

A variance is permission, in writing, from the regulatory authority, to do something the Code would otherwise not allow - because you have demonstrated an alternative way of controlling the hazard.

It is not a waiver. Nobody is agreeing the hazard does not exist.

The special processes

  • Smoking or curing food as a method of preservation rather than for flavor
  • Using food additives or components such as vinegar to render a food non-TCS
  • Packaging food using a reduced-oxygen method
  • Operating a molluscan shellfish life-support display tank
  • Custom-processing animals for personal use
  • Sprouting seeds or beans
  • Offering live animals other than in permitted circumstances

The first two are worth reading twice, because both contain a qualifier that decides the answer.

Smoking for flavor is not smoking for preservation

A smoker used to add flavor to ribs that are then cooked to temperature and refrigerated is a cooking method. No variance.

Cold-smoking salmon so it can be held without refrigeration is preservation. Variance.

Same equipment, same smoke, different purpose - and the exam asks it exactly that way.

The vinegar version

Adding vinegar to sushi rice so it can be held at room temperature uses acidification to make the food non-TCS. That needs a variance. Adding vinegar to a salad dressing for flavor does not. Read what the additive is for.

What a variance application contains

  1. A statement of the proposed variance, citing the Code provision involved.
  2. An analysis of the hazards and how the alternative controls them.
  3. A HACCP plan, where one is required.
  4. Supporting information - scientific studies, process authority letters, validation data.

The regulatory authority may grant, refuse, or grant with conditions. Conditions are common, and operating outside them is the same as operating without a variance.

Reduced-oxygen packaging

This is the one most likely to come up, because vacuum sealers are cheap and common.

Removing oxygen removes the competition for Clostridium botulinum, which grows without it and produces a toxin that cooking does not reliably destroy. The Code responds with specific requirements and, for most applications, a variance and a HACCP plan.

There is a narrow exception for packaging with a short refrigerated shelf life under tight controls. It exists, and it is narrow enough that assuming it applies is usually the wrong answer.
