The SFC expects the local regulatory framework paper to have been passed not more than three years before an application is submitted. It is a recency expectation on the application, not an expiry date on the pass.
The most misunderstood rule in Hong Kong licensing, and the misunderstanding runs in both directions.
What the rule says
Individuals are expected to obtain the recognised industry qualification and pass the local regulatory framework paper not more than three years before the application is submitted.
That is a condition on the application. It is not a statement that the pass evaporates.
People assume one of two wrong things: that the certificate is good forever regardless, or that it dies at three years and must be re-sat. Neither is right. The pass stands; what the SFC weighs is how recent it is relative to the application in front of it.
The carve-out
The SFC may recognise a paper passed more than three years ago where the individual is, or has been, a licensed representative or responsible officer within the past three years for a regulated activity to which that paper is relevant.
So continuous industry presence protects an older pass. A gap does not.
The worked example the SFC gives
Someone who has passed Papers 1 and 7 and has been licensed for type 1 within the past three years is not required to re-take both examinations when applying to additionally carry on type 2.
Adding an activity while you are already in the industry is the easy case. It is the re-entry case that bites.
Who this actually affects
- Anyone who passed the paper and then did not get licensed
- Anyone who left the industry for more than three years and is coming back
- Anyone who sat the paper speculatively while job hunting and took longer than expected
- Anyone relocating back to Hong Kong after a stint elsewhere
The practical reading
If you are sitting Paper 1 without a job offer, the clock you should watch is not the certificate. It is how long your search runs.
Three years is generous for a search and unforgiving for a career break, and it is the second group who are surprised.
Common questions
Does HKSI Paper 1 expire?
The pass does not expire. The SFC expects it to have been obtained not more than three years before an application is submitted.
What if I passed more than three years ago?
The SFC may still recognise it where you are or have been licensed within the past three years for a relevant regulated activity.
Does the rule affect adding a regulated activity?
Usually not, if you are currently licensed. The SFC gives that as its own worked example.
Who does it catch?
People returning after a break of more than three years, and people who passed without ever getting licensed.
Should I sit the paper before I have a job?
It is common. Just note the clock runs from the pass, not from the job offer.
