The short answer

A qualifying party is the named individual whose examination and experience support a company's license. They are answerable for the company's work, and their departure puts the license at risk.

A company cannot sit an examination. A person does, and the company's license rests on them.

What the role is

The named individual whose examination results and experience satisfy the state's requirements on behalf of the company holding the license.

States use different names - qualifying party, qualifying individual, qualifier, responsible managing employee - and the substance is broadly the same.

What it carries

  • Responsibility for the company's construction operations
  • Exposure to disciplinary action for the company's conduct
  • A requirement of genuine involvement, not a name on a form
  • Limits, in many states, on qualifying for more than one company
Qualifying for somebody else is a real commitment

You are lending your license to their business. If they do defective work, breach the licensing law or fail to pay subcontractors, you are the person the board looks at. Being paid a fee for the arrangement does not change that, and several states treat sham qualifying arrangements as serious misconduct.

The company generally has a limited period to replace them or the license lapses.

That is a genuine business risk for a company built on one person's qualification, and a reason to have a second qualified individual in the business. It is a real commitment.
